These are the Jar Developments general terms and conditions governing your access and use of all your activity on the bricast.com website (collectively, the "Service"). You acknowledge and agree that all User-Contributed Content, whether publicly posted or privately transmitted, is the sole responsibility of the person or entity posting that Content. You agree that you, and not bricast.com, are entirely responsible for all Content that you upload, post, send to your mobile phone, email or otherwise transmit via the Service. You further agree that you either own or have sufficient rights in the Content to upload or post such Content.

Bricast.com does not guarantee the accuracy, integrity or quality of any Content. You acknowledge and agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

You are responsible for maintaining the confidentiality of any password and user ID issued to you, and are fully responsible for all activities that occur under your password or ID.

You agree to
(a) immediately notify bricast.com of any unauthorized use of your password or account or any other breach of security, and
(b) ensure that you exit from your account at the end of each session. bricast.com cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.

a. You agree that you will not use the Service to upload, post, email, otherwise transmit, or post links to any Content, that:
you do not have the legal rights to (either by ownership or by having a valid license);
violates or misappropriates any intellectual property right, including copyright, trademark, trade secret, and patent rights;

e. You agree not to engage in any activity which may compromise the stability or availability of the Service or use the Service to compromise the availability or stability of any third party site or service.

f. You agree not to use the Service for any unsolicited advertising or promotions.

g. You agree not to upload, post, email, otherwise transmit, or post links to any Content that contains software viruses, worms, trojan horses, time bombs, trap doors or any other computer code, files or programs or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of the Service or any third party software, site, equipment or service.

i. You may not circumvent any security measures or any payment collections methods employed on the Service, or access the Service after your account or access has been terminated by bricast.com.

In addition, if you post such Content, you acknowledge and agree that bricast.com, at its sole discretion, may disable your uploading or posting privileges and/or terminate your subscription and account. Notwithstanding the previous sentence, you shall remain responsible for such Content and acknowledge and agree that you shall indemnify and hold harmless bricast.com from any and all damages or losses resulting from your posting of such Content.

Because bricast.com's website contains User-Contributed Content, you acknowledge that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances shall bricast.com be liable in any way for the use of such Content, including, but not limited to, any errors or omissions in any such Content, or for any loss or damage of any kind incurred as a result of the use of any such Content posted, emailed or otherwise transmitted via the Service.

You agree that you may receive notices from bricast.com by any of the following methods: by email, SMS or other message to your mobile number or by notice posted on the Service. bricast.com reserves the right to communicate with you regarding your use of the Service.

We undertakes to obey all copyright laws. We will individually review any claims of copyright infringement received and remove content that we determine as being posted or distributed in violation of any such laws in accordance with the Digital Millennium Copyright Act ("DMCA").

We shall
(a) remove Content that we determine to be copyrighted and distributed by any of our users; and
(b) remove and discontinue service to repeat offenders.

You acknowledge that we do not examine or edit the use to which you or others put the Service or the nature of the content or information being accessed and that we are excluded from all liability of any kind arising from such content or information.
